Diadao is a digital and marketing agency dedicated to hospitality and tourism (hotels, restaurants, spas and tourism operators). The site’s artistic director is Mr Serge Bija, in his capacity as founder of Diadao.

4 – Site Content and Intellectual Property

5 – License for Use of Content

By the mere fact of connecting to the Site, the user accepts from Corte di Valle a licence to use the Site content strictly limited to the following binding conditions.

This licence is granted on a non-exclusive and non-transferable basis. The right of use granted to the user is personal and private: consequently, any reproduction of the Site content on any medium for collective or professional use, even internally within a company, is prohibited. The same applies to any communication of such content by electronic means, including on a company intranet or extranet.

The right of use only includes authorisation to consult the Site and its content. This use includes authorisation to reproduce for storage purposes for display on a single-user screen and reproduction in one copy, for backup and printout purposes. Any other use is subject to the express prior authorisation of Corte di Valle. Violation of these provisions exposes the offender to the criminal and civil penalties provided for by Italian law.

6 – Contractual Limitations on Technical Data

The Site uses WordPress CMS technology (PHP, HTML, JavaScript, CSS).

Corte di Valle cannot be held liable for material damages related to the use of the Site. In addition, the user of the Site agrees to access it using recent devices, free of viruses, and with a state-of-the-art browser.

The Site is hosted by o2switch within the territory of the European Union, in compliance with Regulation (EU) 2016/679 (GDPR) and Italian Legislative Decree no. 196/2003 (Privacy Code) as amended by Legislative Decree no. 101/2018.

The aim is to provide a service that ensures the highest level of accessibility. The host ensures continuity of service 24 hours a day, every day of the year. However, it reserves the right to interrupt the hosting service for the shortest possible time, in particular for maintenance purposes, to improve its infrastructures, in the event of infrastructure failure or if the services generate traffic deemed abnormal.

Corte di Valle shall not be held liable in the event of malfunction of the Internet network, telephone lines or computer equipment, in particular due to network congestion preventing access to the server.

7 – Protection of Personal Data

Società Agricola Corte di Valle Wine and Resort S.r.l., with a share capital of € 10,000.00, registered with the Florence Business Register, is the Data Controller for the personal data collected through the Site. The contact for such data collection is Mr Pierre Mariani, in his capacity as Chairman of the Board of Directors.

The data collected and stored is hosted by 5Stelle* S.r.l., with registered office at Via Nazionale 19, 43058 Sorbolo Mezzani (PR), Italy. 5Stelle* is a provider of hotel management software (PMS) and cloud solutions, appointed as Data Processor under Article 28 of the GDPR.

The user is informed that, pursuant to Regulation (EU) 2016/679 (GDPR) and Italian Legislative Decree no. 196/2003 (Privacy Code) as amended by Legislative Decree no. 101/2018, the information communicated through the forms on the Site is necessary to respond to the user’s request and is intended for the departments in charge of handling such requests.

The data collected on the Site through forms shall be retained for the specific periods set out in the Privacy Policy, according to the principle of data minimisation (Article 5(1)(c) GDPR). At the end of such periods, personal data will be deleted or anonymised.

Under Articles 15-22 of the GDPR, users have the right to access, rectification, erasure, restriction of processing, data portability and objection regarding personal data concerning them. The https://cortedivalle.com website uses the SSL (Secure Socket Layer) security protocol, the most widely used in the world. It enables the protection and encryption of information transmitted between Corte di Valle and users of the Site. To ensure the security and confidentiality of personal data, the Site uses networks protected by standard devices such as firewalls, pseudonymization, encryption, and passwords.

For online booking services, users’ data are stored on a centralized server hosted by 5Stelle* S.r.l., the Data Processor.

9 – Booking and Payment System

When booking on the Site, the browser/user may be redirected to a sub-provider offering a booking and payment management solution.

The personal data collected is shared with D-EDGE, a French simplified joint-stock company (SAS), with a share capital of € 12,700,298.40, registered with the Paris Trade and Companies Register under number 431 513 852 00076, with registered office at 14-16 Boulevard Poissonnière, 75009 Paris, France. D-EDGE is appointed as Data Processor under Article 28 of the GDPR.

The data collected through D-EDGE is used for booking and guest management, billing and payment, as well as commercial activities and satisfaction surveys.

The information contained on the Site is not contractual in nature and may be modified without notice. Corte di Valle reserves the right to modify the content of the Site and these General Terms and Conditions of Use at any time and without notice. Such modifications are binding on the user, who is invited to consult the Site regularly.

Corte di Valle respects users’ privacy and is committed to protecting it. The website and the company’s activities are governed by Italian law. In the event of any dispute arising from the use of the Site, the Court of Florence shall have exclusive jurisdiction, subject to mandatory consumer protection provisions (Article 66-bis of the Italian Consumer Code).
